Georgia is a no fault state in granting a divorce, but all issues with regard to fault are admissible, including, but not limited to, infidelity, child abuse, and the like. Property DivisionAll assets and debts accumulated during the marriage are marital. During the divorce, you and your spouse must divide them between you. All property must be divided equitably. This doesn’t have to be a 50/50 division, but that’s a common solution. Children and DivorceIf there are children involved, you have to work with your spouse to devise a parenting plan unless you want a judge to do it for you. I have always thought the parents ought to know better than a third person what is best for their children. You should decide who becomes the primary custodial parent, unless, again, you force a judge to make that decision. You should also decide the terms of visitation, and the amount of child support. Divorce can be very hard on children. I know that you want the best for them. I am willing to work with you to make this transition as smooth for them as possible. AlimonyAlimony, also called spousal support or spousal maintenance, is not as common as it once was. Often, alimony is intended to permit a non-working spouse to enter the work force or achieve a higher level of education.
